General Terms and Conditions (GTC)

1. Scope

1.1 WoodVolts® is a commercial offer by Christian Schlittenbauer, Hauptstraße 20, 95173 Schönwald, woodvolts@gmx.de

1.2 These General Terms and Conditions (hereinafter “GTC”) of WoodVolts® (hereinafter “Seller”) apply to all contracts for the delivery of musical goods concluded by end consumers or merchants (hereinafter “Customer”) with the Seller via the online offer of the Seller. Any conflicting terms of the Customer are hereby rejected unless otherwise agreed in writing.

1.3 An end consumer according to these GTC is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional.

1.4 Merchants within the meaning of these GTC are natural or legal persons or a legally capable partnership who act in exercising their commercial or independent professional activity when concluding a legal transaction.

2. Conclusion of Contract

2.1 The contract language is German.

2.2 Subject matter of the contract is the sale of musical goods.

2.3 The product descriptions contained in the Seller’s online offer do not constitute binding offers but serve for customer information, on the basis of which the customer submits a binding offer.

2.4 The customer may submit the offer by email or telephone to the Seller.

2.5 The Seller may accept the customer's offer within five working days by:

  • Sending a written order confirmation or order confirmation in text form (fax or email) to the customer, the receipt of which by the customer is decisive;

  • Delivering the ordered goods to the customer, the receipt of which by the customer is decisive;

  • Sending a payment request (invoice for prepayment) after order submission.

If several of these alternatives occur, the contract is concluded at the time the first occurs. The acceptance period begins the day after the customer's offer is sent and ends after five working days. If the Seller does not accept within this period, the offer is deemed rejected, and the customer is no longer bound by the order.

2.6 Order processing and communication usually take place by email. The customer must ensure the email address provided is valid to receive emails from the Seller. The risk of emails not received due to spam or filters lies solely with the customer.

3. Right of Withdrawal

3.1 Consumers generally have a right of withdrawal.

3.2 More detailed information about the right of withdrawal is provided in the Seller’s withdrawal policy.

4. Prices and Payment Conditions

4.1 Unless otherwise stated, prices include statutory VAT. Shipping and delivery costs are noted separately.

4.2 The goods usually fall under differential taxation according to § 25a UStG; VAT is not separately shown. If VAT can be shown separately, this will be noted.

4.3 Prepayment via bank transfer is due immediately after contract conclusion unless otherwise agreed.

4.4 If payment by invoice is agreed, delivery for first orders is after receipt of payment; for further orders, immediate payment upon invoicing applies.

5. Delivery and Shipping

5.1 Delivery is to the address provided by the customer during ordering unless otherwise agreed.

5.2 If delivery fails due to customer fault, the customer bears reasonable costs, except in cases of withdrawal.

5.3 Risk passes to the customer upon handover to the carrier. For consumers, risk passes upon receipt unless the carrier was chosen by the customer and the Seller did not name the carrier in advance.

5.4 The Seller reserves the right to withdraw from the contract in case of non-availability, provided the Seller is not responsible.

6. Retention of Title

6.1 Ownership of goods remains with the Seller until full payment by the customer.

6.2 For merchants, ownership remains until all claims from ongoing business relations are settled; resale is permitted, and claims from resale are assigned to the Seller.

7. Warranty

7.1 For merchants:

  • The Seller chooses the type of remedy;

  • Warranty period is one year for new goods;

  • No warranty rights for used goods.

7.2 Exceptions apply for damages from fraudulent concealment.

7.3 Statutory limitation periods for recourse claims remain unaffected.

7.4 Merchants must inspect and report defects per § 377 HGB; otherwise, goods are deemed approved.

7.5 Consumers should report transport damage to the carrier and notify the Seller.

7.6 No warranty for goods sold on commission.

8. Liability

8.1 The Seller is fully liable for intent, gross negligence, injury to life, body, health, warranty promises, and mandatory liability (e.g., product liability).

8.2 For slight negligence of essential contractual duties, liability is limited to foreseeable damage.

8.3 Liability otherwise excluded.

8.4 These rules apply also for liability of vicarious agents.

9. Governing Law, Place of Performance, Jurisdiction

9.1 German law applies even for foreign customers. Court of jurisdiction is Schönwald; Seller may also sue at customer’s general jurisdiction.

9.2 UN Sales Convention does not apply.

10. Alternative Dispute Resolution

10.1 EU Commission’s Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

10.2 Seller neither obligated nor willing to participate in dispute resolution before consumer arbitration boards.

11. Miscellaneous

11.1 Invalid provisions do not affect others. Terms may be changed without notice.

11.2 No legal warnings without prior contact. If rights are violated, please contact us first by email or phone.

11.3 External links are not controlled by the Seller; no liability for linked content.

Withdrawal Policy

Right of Withdrawal for Consumers

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

 

Right of Withdrawal

​

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day

  • on which you or a third party named by you, who is not the carrier, took possession of the goods, if you ordered one or more goods under a single order and these are delivered together;

  • on which you or a third party named by you, who is not the carrier, took possession of the last item, if you ordered several goods under a single order and they are delivered separately.

To exercise your right of withdrawal, you must inform me (Christian Schlittenbauer, Hauptstr. 20, 95173 Schönwald, woodvolts@gmx.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email). You may use the sample withdrawal form below, adding your personal information, address, and the goods purchased.

To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

 

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for the additional costs resulting from your choice of a different type of delivery than the cheapest standard delivery we offer), without undue delay and at the latest within 14 days from the day we received your notice of withdrawal from this contract.

For this repayment, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment.

 

We may withhold the reimbursement until we have received the goods back or you have provided proof that you have returned the goods, whichever is earlier.

 

You must return or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of 14 days has expired.

 

You bear the direct costs of returning the goods.

 

You are only liable for any diminished value of the goods if this loss in value is due to handling them in a way that is not necessary to examine the nature, characteristics, and functioning of the goods.

 

Exclusion and Premature Expiry of the Right of Withdrawal

 

The right of withdrawal does not apply to contracts

  • for the delivery of goods that are not prefabricated and for whose production an individual choice or decision by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;

  • for the delivery of goods that are liable to deteriorate rapidly or whose expiry date would be quickly exceeded.

The right of withdrawal expires prematurely for contracts

  • for the delivery of sealed goods which are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery;

  • for the delivery of goods which, after delivery, are inseparably mixed with other items due to their nature.
